1.1 The conditions below shall prevail over any inconsistent terms or conditions contained, or referred to anywhere or implied by law, trade custom, practice or course of dealing. This will not change your statutory rights.
1.2 Kaizen Academy reserves the right to change minor points on the contract. This will not change your statutory rights.
2.1 There will be three different types of membership available: “unlimited” membership, “regular” membership and “basic” membership. “Unlimited” membership allows access to an unlimited number of classes a week. “Regular” membership allows access to 3 classes a week. “Basic” membership allows access to 2 classes a week.
2.2 Customers can pay as you go for each session attended (this will charged at the current rate – viewable on the website here: https://kaizenlancaster.co.uk/pricing) or purchase a membership. Memberships are binding contracts with set durations of: 1 month, 3 months or 12 months. The payment will be charged monthly on the same day as the customer signed up (i.e. if the customer signed up on the 7th of November, the first payment will come out on the 7th of November, the 2nd payment will come out on the 7th of December, the 3rd payment will come out on the 7th of January, and so on…).
2.3 When purchasing a membership, members will select both their membership type (i.e. “unlimited”, “regular” or “basic”) as well as their contract duration (i.e. “1 month”, “3 months” or “12 months”).
2.4 Once a membership has been purchased, there is a 14 day cooling off period during which members may cancel their membership. After this cooling off period has elapsed, members will be able to cancel their 3 month membership by paying the value of 1 month upfront or their 12 month membership by paying the value of 2 months upfront (e.g. you can cancel your 12 month membership of £60/month, by paying £120 upfront).
2.5 If at any point a payment fails, Kaizen Academy will give members 3 weeks to make the payment after which the membership will be cancelled and the debt sold to a debt-collection company. This may affect the members’ credit rating or have other adverse effects. During the 3 weeks, members can still attend classes as normal.
2.6 In case of minor injuries (i.e. injuries that prevent the member from training for less than 12 months), Kaizen Academy will suspend the membership for the duration of the injury. The suspended months will not count toward the completion of the contract (i.e. if a member is on a 12 month contract but suspended his membership for 3 months due to injury, the contract will now finish after 15 months rather than the initial 12). Kaizen Academy will still require proof in the form of a medical note in order to suspend the membership.
2.7 Memberships are set to automatically renew once they have ended. When they renew, they will renew onto the prices at that current in time (these will always be viewable on our website here: https://kaizenlancaster.co.uk/pricing. If a member doesn’t want to renew, he/she must call, e-mail or speak to a member of the Kaizen team in person. Members will receive an e-mail 1 month, 2 weeks and 1 week before their membership runs out reminding them that it is set to automatically renew. Once the membership automatically renews, members will have a 14 day cooling off period in which to cancel their membership. If members cancel within these 14 days, Kaizen Academy will refund the payment fully and cancel the membership. If members do not cancel within these 14 days, the membership will have renewed successfully and will be counted as a normal membership, subject to all the terms above.
2.8 In order to qualify for a student membership, students must produce a proof of student eligibility when purchasing or renewing their membership.
2.9 Memberships do not include private sessions or consultations.
2.10 All members will be issued a login and password to the Kaizen Academy website such that they can access the members area. From this members area they will be able to view the Kaizen Kickboxing and Brazilian Jiu Jitsu syllabuses, track their progress on each of the disciplines, view the class schedule for any given week, book into classes, view their membership status, upgrade their membership and among other things.
2.11 Memberships can be upgraded or downgraded by asking a member of the Kaizen team.
2.12 The membership is not transferable and must be used only by the registered member.
2.13 Kaizen reserves the right to cancel any membership if we view the member in question to be breaching our rules of conduct or behaving in a way which we deem offensive or dangerous. If this is the case, we will cancel the membership and the member will not be liable to pay the remaining months of his/her contract.
2.15 Kaizen reserves the right to refuse membership or admittance when there are reasonable grounds to do so.
3.1 All students must book classes before they attending either online, by phone or the academy once they arrive. All classes must be paid before students enter the training area or changing rooms.
3.2 All students must attend a foundation class before attending any other classes unless otherwise specified.
3.3 All classes are open all members. However, certain classes such as Postgraduate classes may be more advanced and cover more challenging material.
3.4 Guests may enroll onto classes pending a single class payment. Guests are also encouraged to complete a foundation session with a Kaizen coach prior to joining an undergraduate or postgraduate class.
3.5 All classes must be cancelled prior to session starting. Where possible a minimum of one hour’s notice is preferable.
4.1 Strictly no shoes to be worn on the mats. When exiting the mats members must wear shoes.
4.2 Members must have their fingernails and toenails clipped.
4.3 Members must meet basic personal hygiene standards to train.
5.1 Kaizen is fully insured with employer liability insurance, public liability insurance, member-to-member insurance as well as instructor insurance. As such, members will not have to pay any insurance.
6.1 Kaizen Academy recommends members leave valuables at home or in their cars. Kaizen Academy does not take responsibility for any lost or damaged property.
6.2 All lost property will be kept for a period of 8 weeks before being disposed of.
7.1 Smoking, including the use of e-cigarettes, is not permitted on the Kaizen premises.
7.2 All customers must inform staff of any medical conditions that may affect their use of the facilities.
7.3 No pets are allowed into the facilities with the exception of guide dogs.
8.1 Kaizen will be open from 30 minutes before the first class on the schedule that day to 30 minutes after the last class on the schedule that day. To check schedule, refer to website: www.kaizenlancaster.co.uk.
8.2 Kaizen may close fully or partially for holidays. This will be announced a minimum of a week before on our Facebook page and by e-mail.
8.3 Kaizen reserves the right to change the timetable of classes or instructors without prior notification. However, where possible, 7 days notice will be given.
